Welcome to MaxHome. By downloading, installing, or using the MaxHome application ("App") or any related services ("Services"), you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account or using MaxHome, you confirm that you are at least 13 years of age and agree to be bound by these Terms. If you are using MaxHome on behalf of a family, you represent that you have the authority to bind your household to these Terms.

2. Description of Service

MaxHome is a family AI assistant application that provides conversational AI, family organization tools, scheduling, homeschool management, budget tracking, grocery lists, and related features. MaxHome is powered by third-party AI providers including Anthropic (Claude).

MaxHome's AI assistant ("Max") is for informational and organizational purposes only. Responses generated by Max do not constitute professional medical, legal, financial, psychological, or other licensed professional advice. Always consult a qualified professional for advice specific to your situation.

MaxHome is not a medical device, mental health treatment, or therapeutic service. If you or a family member are experiencing a mental health crisis, please contact emergency services or a licensed mental health professional immediately.

You must provide accurate information when creating your account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at info@maxhome.app if you suspect unauthorized access.

MaxHome is intended for users aged 13 and older. Children's profiles within the App are created and managed by a parent or legal guardian. We do not knowingly collect personal information directly from children under 13. If you believe a child under 13 has provided personal information without parental consent, contact us at info@maxhome.app and we will promptly delete that information.

Parents are responsible for supervising their children's use of MaxHome and for configuring Kids Mode appropriately.

Your use of MaxHome is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using MaxHome, you consent to the collection and use of your information as described in the Privacy Policy.

We implement industry-standard security measures to protect your data. However, no method of transmission over the internet is 100% secure. You acknowledge that you provide your information at your own risk. In the event of a data breach that affects your personal information, we will notify you as required by applicable law.

MaxHome integrates with third-party services including Anthropic (AI), Twilio (SMS), and others. Your use of these features is subject to the respective third-party terms and privacy policies. We are not responsible for the practices of third-party services.

All content, features, and functionality of MaxHome — including but not limited to text, graphics, logos, and software — are the exclusive property of MaxHome and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

12. Disclaimers and Limitation of Liability

MaxHome is provided "as is" without warranties of any kind. To the fullest extent permitted by law, MaxHome shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or Services, including but not limited to loss of data, loss of profits, or personal injury.

Our total liability to you for any claim arising from these Terms or your use of MaxHome shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless MaxHome, its officers, directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

We may suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the App ceases immediately. Provisions that by nature should survive termination will survive.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via the App or email. Continued use of MaxHome after changes constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Alberta, Canada.
